Planning Committee Update – January 2019

In December 2018, an action was commenced in Supreme Court, Dutchess County, for a judgment determining that title to the Thorne Building property is free of any claim of interest of the so-called “reverter”, or any other adverse claim.   The “reverter” language indicates that if the property was not used for educational or other related purposes, title would “revert” back to the original grantors.   If there is no meaningful opposition to the Village’s claims, we hope that the Court will issue its judgment – – holding that title is free of any claims – – by June 1, 2019.

The Village will also be entering a contract with the Thorne Building Community Center, a not for profit organization (501c3), to transfer title to the property, very likely this month.  That contract states, among other terms, that title will pass once it has been cleared by the above action.   Thank you.
